That's trespassing, just for starters, and I have no way to know what his intentions are, and whether he has a weapon. I just know he's in my house, taking stuff that isn't his. No, and so doesn't a judge. Maybe you just invited a guy you hate over to your house to kill him knowing that when you say you just defended your house and your family you would go free.
